1.2 By placing an order through the webshop, the customer agrees to these Terms and Conditions.
1.3 The webshop offers high-quality printed reproductions of artworks created by independent artists. These prints are produced and distributed by Nori Art from its warehouse in the Netherlands
2. Nature of the Products
2.1 The products offered in the webshop are art prints (reproductions) of artworks created by independent artists.
2.2 The prints are produced using professional printing techniques and high-quality materials.
2.3 The images displayed on the website are intended for illustration purposes. Slight variations in color, texture, or size may occur due to screen settings and printing processes.
3. Role of the Webshop
3.1 Nori Art acts as a distributor and sales platform for artworks created by independent artists.
3.2 Unless explicitly stated otherwise, Nori Art does not own the intellectual property rights to the artworks displayed in the webshop.
3.3 The webshop sells printed reproductions on behalf of the respective artists, under agreements made with those artists.
3.4 The artist remains the copyright holder of the original artwork.
4. Intellectual Property Rights
4.1 All intellectual property rights, including but not limited to copyrights, moral rights, and image rights related to the artworks, remain the exclusive property of the respective artist unless explicitly transferred in writing.
4.2 Purchasing an art print does not transfer any intellectual property rights to the buyer.
4.3 Customers may only use the purchased prints for personal and non-commercial purposes.
4.4 It is strictly prohibited to reproduce, distribute, modify, scan, digitize, or commercially exploit the artworks without prior written permission from the respective copyright holder.
5. Artist Responsibility
5.1 Artists who provide artworks for sale through the webshop confirm that:
they are the lawful creator or rights holder of the artwork, and
the artwork does not infringe the intellectual property rights of any third party.
5.2 The artist indemnifies Nori Art against claims from third parties relating to copyright infringement or ownership disputes concerning the artwork.
6. Prices and Payment
6.1 All prices displayed on the website are in Euro (€) and include VAT unless stated otherwise.
6.2 Shipping costs will be clearly displayed during the checkout process.
6.3 Payment must be completed using the payment methods provided in the webshop before the order is processed.
7. Delivery
7.1 Orders are processed and shipped from the warehouse of Nori Art located in the Netherlands.
7.2 Estimated delivery times are indicated on the website but may vary depending on location and shipping carrier.
7.3 The risk of damage or loss transfers to the customer once the package has been delivered to the specified delivery address.
8. Right of Withdrawal
8.1 Consumers have the right to cancel their purchase within 14 days after receiving the product, without providing a reason.
8.2 To exercise the right of withdrawal, the customer must notify Nori Art within the 14-day period.
8.3 The product must be returned unused and in its original condition and packaging.
8.4 The direct cost of returning the product is borne by the customer unless stated otherwise.
8.5 The purchase amount will be refunded within 14 days after receiving the returned product, using the same payment method used for the original transaction.
9. Liability
9.1 Nori Art strives to provide accurate information on the website but cannot guarantee that all information is always complete or error-free.
9.2 Nori Art shall not be liable for indirect damages, consequential damages, or loss of profits resulting from the use of the website or products.
9.3 Liability, if applicable, shall be limited to the total amount paid by the customer for the relevant order.
10. Website Use
10.1 Users may not use the website for unlawful activities.
10.2 It is prohibited to copy, distribute, or reuse website content, images, or product visuals without written permission.
11. Governing Law
11.1 These Terms and Conditions are governed exclusively by the laws of the Netherlands.
11.2 Any disputes arising from these Terms and Conditions shall be submitted to the competent court in the Netherlands.
